The IDEA and Section 504
The Individuals with Disabilities Education Act (“IDEA”), Section 504 of the Rehabilitation Act of 1973, provide a complex set of procedural and substantive rights to students with disabilities. If the evaluation report concludes that your child has a disability and is in need of special education services, then the school district must issue and implement an Individualized Education Program (IEP) to ensure that your child receives a Free Appropriate Public Education (FAPE). An IEP is a document, which describes the type of education program that is to be delivered to address your child’s unique needs and includes goals and specially designed instruction.
